These Terms of Service ("Terms") govern your access to and use of treasuredsong.com (the "Site"), operated by TreasuredSong ("TreasuredSong," "we," "us," or "our"), including our custom song creation services, any optional physical keepsake products, and all related communications (together, the "Services").
By visiting the Site, placing an order, or submitting information through our order form, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Services, you confirm that:
- You are legally able to enter into these Terms;
- The information you provide is accurate to the best of your knowledge;
- You have the right to share any names, stories, or personal details you submit, including details about third parties.
2. What We Do
TreasuredSong creates original custom songs based on the story, names, and details you share with us through our order form. Lyrics are written from your submission, and the music is composed and produced by our team.
Every song is a creative and artistic interpretation of the details you provide. Because reactions to music are personal and subjective, we cannot guarantee a specific emotional response, a specific lyrical phrase-for-phrase match to your request, or a specific musical style beyond what you select.
We reserve the right to decline any order, at our discretion, including (but not limited to) orders that request illegal, hateful, or otherwise inappropriate content.
3. Your Content & Your Responsibility
You are solely responsible for everything you submit to us, including any names, stories, messages, or references to other people. By submitting content, you confirm that:
- You have the right to share it;
- It does not infringe on anyone's copyright, trademark, privacy, or other rights;
- It is not unlawful, defamatory, hateful, or obscene;
- Where your story includes another person, you have their consent to share it with us.
You agree to hold TreasuredSong harmless from any claim arising from content you submit to us.
4. License You Grant to Us
By submitting your story and details, you grant TreasuredSong a non-exclusive, royalty-free license to use, reproduce, and adapt that content solely for the purpose of creating, producing, and delivering your song and related products. This does not give us ownership of your personal story — only permission to use it to complete your order.
5. Ownership of Your Song
The lyrics, melody, and final recording we create are owned by TreasuredSong. Once your order is paid in full, you receive a non-exclusive, personal-use license to:
- Play the song privately;
- Share it with family and friends;
- Use it at personal events such as birthdays, weddings, or memorials.
Unless you have our written permission, you may NOT:
- Sell the song or use it commercially;
- Upload it to streaming platforms (Spotify, Apple Music, etc.) under your own name;
- Claim authorship of the song;
- Register it with a performing rights organization;
- License or resell it to a third party.
6. Communications
By providing your email address, you agree to receive order-related communications (confirmations, delivery updates, support replies) from us. We may also send occasional promotional emails, which you can unsubscribe from at any time using the link in those emails. You will still receive order-related messages even if you opt out of marketing emails.
7. Delivery
Digital songs are typically delivered by email within 24–48 hours of your order. A faster delivery option may be available for an additional fee at checkout.
If you've added an optional physical keepsake (such as a printed lyric art piece), that item ships separately and its delivery time will be shown at checkout — it is not part of the 24–48 hour digital delivery window.
We are not responsible for delivery issues caused by an incorrect email address, spam filtering, or outages beyond our control. Please download and save your song after delivery, as we do not guarantee permanent file hosting.
8. Revisions
If your song doesn't feel right the first time, let us know — we will work with you on reasonable revisions until you're satisfied. To keep this fair for everyone, we ask that revision requests relate to the details originally provided in your order rather than an entirely new story or occasion, which would be treated as a new order.
9. Refunds
If, after working through revisions with us, you're still not happy with your song, contact us within 30 days of delivery at cs@treasuredsong.com to discuss a refund. Refunds are considered case by case and are not available if:
- The request comes after you've publicly shared or otherwise used the song;
- You open a chargeback with your bank before contacting us directly;
- The order violates these Terms.
10. Physical Keepsake Products
Optional physical items (such as printed lyric art) are made to order based on your song and are non-returnable except in the case of a printing defect or shipping damage — please contact us with photos within 7 days of delivery if this happens, and we'll arrange a reprint.
11. Not Professional Advice
Our songs are created for sentimental and entertainment purposes. They are not a substitute for professional, legal, medical, or mental health advice.
12. Prohibited Uses
You agree not to:
- Use the Services for any unlawful purpose;
- Submit content that infringes on someone else's rights;
- Attempt to disrupt, scrape, or reverse-engineer the Site;
- Impersonate another person;
- File a fraudulent chargeback.
13. Disclaimer of Warranties
The Services and products are provided "as is." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not guarantee a specific emotional reaction, exact lyrical wording, or uninterrupted service.
14. Limitation of Liability
To the fullest extent permitted by law, TreasuredSong is not liable for indirect, incidental, or consequential damages arising from use of the Services. Our total liability for any claim will not exceed the amount you paid for the order in question, and your sole remedy is a refund of that amount where applicable under Section 9.
15. Indemnification
You agree to indemnify and hold harmless TreasuredSong and its owners and contractors from any claim arising from content you submit, your violation of these Terms, or your misuse of your song.
16. Third-Party Services
We rely on third-party providers for payment processing, hosting, and email delivery. We are not responsible for outages or failures of these third-party services.
17. Force Majeure
We are not liable for delays caused by events beyond our reasonable control, including natural disasters, internet or platform outages, or government actions.
18. Dispute Resolution

19. Chargebacks
If you file a chargeback without contacting us first, you give up eligibility for a voluntary refund, and we reserve the right to dispute the chargeback and decline future orders from you.

21. Severability
If any part of these Terms is found unenforceable, the rest will remain in effect.
